Terms of Service

These Terms of Service ("Terms") apply to your use of the Fairway mobile app and this website (together, the "Service"), provided by Fairway ("Fairway", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Your account

• You must be at least 13 years old to use Fairway.
• You are responsible for keeping your sign-in details secure and for everything that happens under your account. Tell us straight away if you think someone else has accessed it.
• The information you give us must be accurate.
• You can delete your account at any time from your profile in the app.

2. Subscriptions and payments

• Some features require a paid subscription. Prices and what is included are shown in the app before you buy.
• Subscriptions are purchased and billed through the Apple App Store or Google Play and are also governed by their terms. Payment is charged to your store account when you confirm the purchase.
• Subscriptions renew automatically at the end of each period at the same price unless you cancel at least 24 hours before the end of the current period.
• If a free trial is offered, you will be charged when the trial ends unless you cancel at least 24 hours before it ends. Any unused part of a trial is forfeited when you buy a subscription.
• You can manage or cancel your subscription in your store account settings: App Store or Google Play. Deleting the app or your account does not cancel a subscription.
• Refunds are handled by Apple or Google under their refund policies. Nothing in these Terms affects your statutory rights as a consumer.

3. Your content

You own the videos, photos and other content you upload ("Your Content"). You give us a non-exclusive, worldwide, royalty-free licence to store, process and display Your Content only as needed to provide the Service to you, for example to analyse your swing and show it back to you. This licence ends when you delete the content or your account.

You must only upload content you have the right to use. If a recording shows other people, make sure they are happy to be filmed. You must not upload anything unlawful, offensive or that infringes anyone else's rights.

4. Acceptable use

You agree not to:

• use the Service for anything unlawful or harmful;
• copy, modify, reverse engineer or resell any part of the Service;
• interfere with or disrupt the Service, or try to access it by automated means or get around any limits or security measures; or
• share your account or paid access with others.

We may suspend or close accounts that break these Terms.

5. Golf and health

Fairway gives general coaching feedback based on automated analysis of your video. The analysis may not always be accurate, and it is not a substitute for advice from a qualified golf professional, doctor or physiotherapist. Warm up properly, practise within your physical limits, and make sure you have enough space around you before you swing or film. Stop if you feel pain. You use the Service and any drills at your own risk.

6. Our rights

The Service, including its software, design, text, graphics and analysis methods, belongs to us or our licensors. We grant you a personal, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, in line with these Terms and the rules of the app store you downloaded it from.

7. Changes and availability

We are always improving Fairway, so features may change or be removed. We try to keep the Service available but cannot promise it will always be uninterrupted or error-free. If we make a significant change to these Terms, we will let you know in the app before it takes effect.

8. Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, we are not liable for losses that were not foreseeable, for business losses, or for loss of data you could have backed up, and our total liability to you in connection with the Service is limited to the amount you paid us in the 12 months before the claim.

9. Ending these Terms

You can stop using Fairway and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we stop providing the Service, in which case we will give you reasonable notice where we can.

10. Apple-specific terms

If you downloaded Fairway from the Apple App Store, these Terms are between you and Fairway, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Where these Terms are silent, Apple's Standard Licensed Application End User License Agreement applies.

11. Governing law

These Terms are governed by the laws of England and Wales. If you live elsewhere in the UK or in the EU, you also keep the protection of the mandatory laws of the country you live in, and you may bring a claim in your local courts.
